Mr. Milgrim’s treatise, MILGRIM ON TRADE SECRETS, initially published as a single volume work in 1967 and periodically supplemented and revised and is currently five volumes. Trade Secrets has been cited by the Supreme Court and by numerous federal and state courts across the country.
His now four volume treatise, MILGRIM ONLICENSING, initially published in 1990, has been periodically supplemented. It has been cited by the Court in its 2015 closely-watched opinion in Kimble v. Marvel Enterprises concerning hybrid licensing where one of the licensed rights was a patent.
His was the sole amicus brief cited by Judge Friendly in his 1971 landmark trade secret case, Painton v. Bourns, where the court reversed a lower court ruling that had ruled that trade secret law was preempted by the federal patent act.
